Terms of Service

1. Agreement to these terms

These Terms of Service (the “Terms”) are a binding agreement between you and PresaleHQ (“PresaleHQ,” “we,” “us,” or “our”) governing your use of the website at presalehq.io and the related application (the “Service”). By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction, if higher) and able to form a binding contract to use the Service. By using it, you represent that you meet these requirements and that the information you provide is accurate.

3. What PresaleHQ does — and doesn't

PresaleHQ is an independent information and organization tool. It reads publicly available event and presale data (including from Ticketmaster's public Discovery API), helps you organize presales on a calendar, explains how presales are typically unlocked, and — where you enable it — sends you reminders.

We do not sell tickets, and we do not guarantee that you will be able to buy any ticket. We do not control ticketing platforms, inventory, pricing, presale codes, queue placement, or whether a presale occurs, changes, or sells out. Presale data and times can be inaccurate, delayed, or change without notice. The Service does not bypass queues, defeat bot or anti-fraud protections, or circumvent any ticketing platform's rules, and you may not use it to attempt to do so.

4. Your account

You sign in with Google. You are responsible for activity under your account and for keeping your Google credentials secure. Notify us at support@presalehq.io if you suspect unauthorized use. You may delete your account at any time.

5. Acceptable use

You agree not to:

  • Use the Service to violate any law or any third party's terms, including the terms of Ticketmaster, Live Nation, AXS, SeatGeek, or any card issuer or fan-club program.
  • Scrape, harvest, resell, or systematically extract data from the Service, or access it via automated means except as we expressly permit.
  • Attempt to bypass ticketing queues, purchase limits, identity checks, or bot/anti-fraud protections.
  • Interfere with, overload, reverse engineer, or attempt to gain unauthorized access to the Service, its infrastructure, or other users' accounts or data.
  • Resell, sublicense, or commercially exploit the Service without our written permission.

You are solely responsible for how you use any information the Service provides, and for complying with the rules of any ticketing platform you use.

6. Third-party services and non-affiliation

The Service integrates with or references third parties (Google, Stripe, Discord, Ticketmaster, and others). Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.

PresaleHQ is independent and is not affiliated with, endorsed by, or sponsored by Ticketmaster, Live Nation, AXS, SeatGeek, any card issuer, any artist, venue, or fan club. All names and trademarks are the property of their respective owners and are used for identification only.

7. Pro subscriptions and billing

Some features require a paid “Pro” subscription, billed through Stripe at the prices shown on our pricing page (currently $19.99/month or $199.99/year, subject to change with notice). By subscribing, you authorize us and Stripe to charge your payment method on a recurring basis until you cancel.

  • Renewal. Subscriptions renew automatically at the end of each billing period unless cancelled beforehand.
  • Cancellation. You can cancel anytime from your billing settings; cancellation takes effect at the end of the current period, and you keep Pro access until then.
  • Refunds. Except where required by law, payments are non-refundable and partial periods are not prorated.
  • Price changes. We may change pricing; changes apply to future billing periods after reasonable notice.

8. Intellectual property

The Service — including its software, design, and content (excluding third-party data and marks) — is owned by PresaleHQ and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial purposes in accordance with these Terms.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY PRESALE INFORMATION, TIME, CODE, OR ALERT WILL BE ACCURATE, TIMELY, OR DELIVERED. YOU USE THE SERVICE AT YOUR OWN RISK.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRESALEHQ AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF TICKETS, OPPORTUNITIES, PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify and hold harmless PresaleHQ and its operators from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, misuse the Service, or where necessary to protect the Service or other users. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will survive.

13. Governing law and disputes

These Terms are governed by the laws of the State of [Your State], United States, without regard to its conflict-of- laws rules. You agree that any dispute relating to the Service will be brought exclusively in the state or federal courts located in [Your State], and you consent to their jurisdiction, except where applicable law gives you the right to bring a claim elsewhere.

14. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above, and for material changes we will take reasonable steps to notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.
